Terms of Service

These Terms of Service ("Terms") govern your use of the SupaTan mobile application ("App") operated by BySupa ("we", "our", or "us"). By using the App, you agree to these Terms.

1. Nature of the App

SupaTan is a cosmetic and lifestyle app designed to help you manage your tanning sessions. SupaTan is not a medical or health application. Session timing, UV recommendations, and SPF suggestions are estimates based on weather data and your profile. They are not medical advice.

2. Assumption of Risk

Sun exposure carries inherent risks including sunburn, premature aging, and skin damage. By using SupaTan, you acknowledge that:

• You are solely responsible for your sun exposure decisions
• Session recommendations are suggestions, not prescriptions
• You should always follow dermatologist recommendations for your skin type
• UV conditions can change rapidly and may differ from forecast data
• You should apply sunscreen as directed by the product manufacturer, regardless of app suggestions

3. Subscriptions and Purchases

Annual Subscription

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your Apple ID Account Settings
• Any unused portion of a free trial period is forfeited when you purchase a subscription

Lifetime Purchase

• A one-time, non-refundable purchase that grants permanent access to all premium features
• Eligible for Family Sharing as configured in your Apple ID settings

Free Trial

• A free trial may be offered for the annual subscription
• If you do not cancel before the trial ends, you will be automatically charged the subscription price
• Free trials are limited to one per Apple ID

4. Permitted Use

You may use SupaTan for personal, non-commercial purposes. You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App
• Redistribute, sublicense, or resell access to the App

5. Intellectual Property

All content, features, and functionality of SupaTan — including design, code, graphics, and text — are owned by BySupa and protected by copyright and other intellectual property laws.

6. Data and Privacy

Your use of SupaTan is also governed by our Privacy Policy, which describes how we collect and use your information.

7. Disclaimer of Warranties

SupaTan is provided "as is" without warranties of any kind. We do not guarantee the accuracy of UV data, weather forecasts, or session recommendations. We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, BySupa shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to skin damage, sunburn, or any health-related issues resulting from sun exposure.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify you of significant changes through the App.

10. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict of law provisions.
